Terms of Service

1. Acceptance of Terms

By accessing or using LingoWave ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

These Terms apply to all users of LingoWave, including the web application at app.lingowave.io and the landing page at lingowave.io.

2. Description of Service

LingoWave is a free AI-powered language learning platform that provides interactive vocabulary exercises, AI-generated practice sessions, live AI dialogue, flashcards, word collections, progress tracking with spaced repetition, text-to-speech pronunciation, and translation assistance.

The Service is currently offered free of charge. We reserve the right to introduce paid features or subscription plans in the future, at which point these Terms will be updated.

The Service is provided "as is" and may be modified, updated, or discontinued at any time without prior notice.

3. Eligibility

You must be at least 16 years old (in the EU/EEA) or 13 years old (outside the EU/EEA) to use LingoWave. By creating an account, you represent that you meet the applicable age requirement.

4. Account Registration

You may create an account using email and password or Google OAuth. You are responsible for:

• Providing accurate information during registration
• Maintaining the confidentiality of your credentials
• All activity that occurs under your account

If you believe your account has been compromised, contact us immediately at contact@lingowave.io.

5. User Content

"User Content" includes text, URLs, PDFs you submit for exercises, voice recordings during dialogue, word collections, exercise answers, and avatar images.

By submitting User Content, you grant LingoWave a limited, non-exclusive, worldwide, royalty-free license to process, store, and transmit your content solely for providing the Service. This includes transmitting content to third-party services for processing.

We do not claim ownership of your User Content. You retain all rights to content you create or submit.

You may delete collections and avatars through the app. For other data deletion, contact us at contact@lingowave.io.

6. AI-Generated Content

LingoWave uses artificial intelligence to generate exercises, dialogue responses, and other educational content. These features are powered by third-party AI providers, currently OpenAI and Google Gemini.

AI-generated content may contain inaccuracies and is provided for educational purposes only — it should not be relied upon as professional advice. For details on how your data is processed, see our Privacy Policy.

7. Voice Data

By using voice features (live dialogue, voice input), you consent to your voice being captured, processed by a third-party AI service, and the transcribed text being stored in your account.

LingoWave does not store raw audio recordings. Only transcribed text is retained.

Voice features are optional. All exercises can be completed using text input.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer or disassemble the Service
• Upload harmful, abusive, or illegal content
• Interfere with the Service's security or infrastructure
• Use automated tools (bots, scrapers) without permission
• Create multiple accounts to circumvent usage limits
• Share your account credentials
• Commercially exploit the Service without permission
• Submit content that infringes third-party rights

We reserve the right to suspend or terminate accounts that violate these Terms.

9. Intellectual Property

The Service, including its design, code, branding, and exercise formats, is owned by LingoWave and protected by applicable intellectual property laws. You may not copy, modify, or create derivative works without permission.

You retain ownership of original content you submit. See section 5 for the license you grant us.

10. Third-Party Services

LingoWave integrates with third-party services to provide its features. By using the Service, you acknowledge that your data may be processed by these services. For a full list and details on how your data is handled, see our Privacy Policy. We are not responsible for the practices or policies of third-party services.

11. Disclaimers

The Service is provided "as is" without guarantees of any kind. We do not guarantee specific learning outcomes or uninterrupted availability.

12. Limitation of Liability

To the maximum extent permitted by law, LingoWave and its operator shall not be liable for indirect, incidental, special, or consequential damages, loss of data, service interruptions, or errors in AI-generated content.

Since the Service is currently free, our total aggregate liability shall not exceed €100.

Nothing in these Terms limits liability that cannot be limited by applicable law.

13. Termination

You may stop using the Service at any time. To delete your account, contact us at contact@lingowave.io.

We reserve the right to suspend or terminate accounts for violations of these Terms, compromised accounts, or as required by law.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Poland.

If you are a consumer in the EU, you retain the right to bring proceedings in your country of residence. Nothing in these Terms affects your statutory consumer rights.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. For material changes, we will notify you via the app. Continued use constitutes acceptance.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and LingoWave.
